Vehicle rental conditions without driver
These GENERAL VEHICLE RENTAL CONDITIONS (hereinafter, “General Conditions”) will regulate the contractual relationship between HP VEHICLE RENTAL (hereinafter, “Lessor”) and the paying customer (hereinafter, “Lessee”), in by virtue of which the first assigns the second the use of a vehicle (hereinafter, "Vehicle") for the term, price and other conditions that are stipulated by the parties in the rental contract (hereinafter, "Contract"), which will be made and signed at the Lessor´s facilities.
It is the responsibility of the Lessee to carry a copy of this contract in a visible place at all times in the Vehicle.
1. Object of the contract:
It is the rental without a driver of the Vehicle described in the particular conditions of the Contract for the private transport of passengers and their luggage, complying with all the General Conditions established in this document.
2. Rental period, delivery (Check-Out), return (Check-In) and extension:
The minimum rental period will be 1 day (24 hours) and the maximum will be determined according to the Vehicle selected in the Contract. The rental days will count for periods of 24 hours from the exact time the rented Vehicle was delivered to the Lessee (hereinafter, Check-Out) and until the return of the Vehicle (hereinafter, Check-In), their keys and their documentation to the Lessor, granting HP VEHICLE RENTAL a courtesy period of 120 minutes counted from the date and time of the Check-In of the Vehicle contemplated in the Contract.
In case of not complying with the previous period, it will empower the Lessor to collect the rental amount from the end of the contract until the return of the Vehicle, according to the Current General Rate, established on the website or facilities of the Lessor, the mileage, the damages.
Carrying out the Check-In before the end of the period will not return or refund to the Tenant any amount of the price subscribed in the Contract, since it is considered a unilateral termination of the Contract by the Tenant.
If the Lessee fails to comply with any of the points established in the General or particular Conditions established in the Contract, the Lessor reserves the right to remove the Vehicle from the Lessee at any time, and the Lessor may request damages.
For operational reasons to review the Vehicle, the Lessor reserves the right to replace the Vehicle at any time with another of similar characteristics, previously informing the Lessee.
Check-Out and Check-In will take place at the HP VEHICLE RENTAL facilities where the Contract was signed, within the terms and terms stipulated in the particular conditions of the Contract.
2.1. Contract Extension:
The Lessee must notify by going to the HP VEHICLE RENTAL office where the Contract was made at any time before the end of the rental period established in the Contract. The minimum extension period will be at least 1 day (24 hours) and may be extended according to the particular conditions of the Contract and the contracted Vehicle.
In no case may the price at the beginning of the Contract be used to extend it. In the event that the Lessee wishes to keep the Vehicle for longer than the initially agreed time, the Lessee undertakes to obtain prior express authorization from the Lessor and to immediately pay the amount of the additional deposit for said extension, being the price applicable to the extension period of the rent the one indicated in the Current General Rate.
The Landlord reserves the right to deny the request for extensions for operational reasons.
The use of the Vehicle after the end of the rental period or its extension will be understood as unauthorized use, proceeding to file a complaint for misappropriation.
3. Driver(s):
The Lessee and the additional drivers must be at least 18 years old, and be the holder of a valid driving license during the entire rental period and must present a European ID or Passport, both documents in force, legible and in good condition. Drivers from outside the European Union must present an international driving license, together with the original from their country of origin.
4. Vehicle Maintenance:
The Lessee receives the Vehicle in perfect condition and must keep it in good condition, not allowing any modification, neither exterior nor interior, if there is any type of modification, its restoration to the original state plus possible damages will be charged to the Lessee. Repairs in the workshop or change of spare parts may only be carried out with the express written authorization of the Lessor. No repair expenses will be reimbursed except with the prior consent and acceptance by the Lessor of the budget and of the workshop that carries out the repair. In the event that there is no such express and written consent, it will be the sole responsibility of the Lessee to pay said expenses, both for the workshop and for spare parts.
5. Vehicle Identification:
The Lessee must keep the HP VEHICLE RENTAL identification stickers and license plate holders in the leased Vehicle in order to be able to be identified. The elimination of these elements will entail a surcharge for restitution of €50, for each one, plus the payment of the possible administrative sanction imposed for this concept. According to certain municipal Ordinances, you must also place in a visible place, at all times, the document that is delivered to you to show that the Vehicle is rented, if you fail to comply with said obligation, you must assume said sanction and pay the established management expenses.
6. Found objects:
The Lessee must empty the Vehicle of his personal belongings. The Lessor is not responsible for any object found in the Vehicle. Notwithstanding the foregoing, any object found in the Vehicle may be sent to the Lessee upon express request. If said objects are not claimed within a maximum period of 15 days, they will become the property of HP VEHICLES RENTAL.
7. In case of breakdown or accident outside the agreed rental period:
Once the contractual relationship between the Lessee and the Lessor (hereinafter, the Parties) has ended, the Lessee will be responsible for 100% of the payment of the repairs and expenses caused to the Vehicle.
8. Prices and rates:
The prices of the Contract will be adjusted to the General Current Rate that is exposed to the public at the facilities, HP VEHICLE RENTAL websites or other means that the Lessor considers, whose content expressly states that the Lessee knows prior to this Contract, in particular those referring to the type of vehicle and class of contract that is signed between the Parties. All prices will be indicated and valued in Euros (€). The fuel price will be detailed at the time the Contract is signed between the parties, due to the fluctuation of the fuel price it is impossible for us to inform you in these General Conditions of its value.
9. Coverage:
The Lessor offers you different coverages: All Groups/Segments have: Basic Insurance: includes basic insurance and civil liability, entailing a damage excess, the value of which depends on the category of vehicle contracted.
All Groups/Segments have compulsory and voluntary subscription Civil Liability, individual accidents and legal defense.
None of the types of coverage will cover damage to the insured Vehicle as a result of: wars. natural catastrophes and natural phenomena (hail, blizzards or others), terrorism, riot, or riot; actions of the State Security Bodies and Forces, negligence on the part of the Lessee, abandonment, accident or stoppage of the Vehicle due to crimes or infractions carried out with it. These damages and related services will be paid by the Lessee.
The coverage in no case covers personal effects left, stored or transported in the vehicle. Therefore DO NOT LEAVE ANY OBJECT IN THE VEHICLE AND ALWAYS MAKE SURE IT IS WELL LOCKED.
10. In the event of an accident, criminal or vandal act committed against the Vehicle, the Lessee is obliged to:
Report what happened to the police immediately.
Fill out a friendly accident report according to the official model found in the Vehicle, indicating at least the registration number, name and address of the opposing party as well as the name of the insurer and, when possible, the policy number of the sure.
In a concise and precise way, describe the accident and, where appropriate, write down the names of the witnesses.
Do not prejudge or acknowledge any responsibility for the accident.
Do not leave the Vehicle without taking the appropriate measures to protect it against further damage by leaving it locked and without disturbing traffic.
Immediately report the accident to HP VEHICLE RENTAL.
In the event of an accident or criminal act, the Lessor will not be obliged to offer the Lessee another rental vehicle. The Lessor may offer you a new vehicle, under the current and current conditions at the indicated time, in order to replace the vehicle that was the object of the accident, criminal or vandal act. In this situation, it will be considered that the Contract has ended between the two parties, Landlord and Tenant, and the Tenant must pay all the expenses derived from the Contract to the Landlord.
11. Examples of criminal or vandal acts committed against the Vehicle are:
Theft or theft of the Vehicle.
Theft or theft of exterior or interior parts of the Vehicle such as wheels, tires or seats.
Theft with force causing damage to the windows or the body of the Vehicle.
Vandalism against the Vehicle.
The previous list is drawn up for mere illustrative purposes, not limiting.
12. Unauthorized Use of the Vehicle:
It will be the obligation of the Lessee to use the Vehicle with due diligence and care, in accordance with its characteristics, respecting the current Spanish traffic regulations for motor vehicles and avoiding, in any case, any situation that could cause damage to the Vehicle or to third parties. Likewise, in the event that the provisions of this point are not complied with, it will be understood that an unauthorized use has been made.
It is the obligation of the Lessee not to allow the driving of the vehicle to any person other than those authorized in accordance with this Contract, the Lessee being directly responsible for any damage or harm caused to the vehicle or to third parties in such a case. The Lessee will be fully liable for damages caused to the interior and exterior parts of the vehicle due to its unauthorized use. In case of unauthorized use of the vehicle, the Lessee is obliged to pay all expenses derived from said damages, the specified amount will be paid with a charge to the Lessee's credit card, showing the Lessee his express agreement for all purposes. The signature of the Lessee in the Contract will be considered as the acceptance of the general and particular conditions specified in the contract. Unauthorized use includes, and is not limited to, the following cases cited by way of example:
Participation in competitions.
Ilegal races.
Driving without a permit or circulation license, or without the authorization of the Lessor.
Assignment of the vehicle to a third party.
Push or tow any other vehicle.
Circulation in places that are not suitable for public transport such as beaches, car circuits, etc.
Driving on roads that could lead to damage to the underbody/sump of the vehicle
Negligent action before the lighting of warning lights or warning signs on the vehicle panel that the lessee declares to be aware of when signing this contract.
Transport of furniture, except for vehicles designed for this purpose.
The transport of animals in the vehicle.
The transport of people or goods that directly or indirectly implies a payment to the Lessee (for example, using the Vehicle as an illegal "Taxi")
The sublease of the vehicle.
Transporting a number of people or a quantity of luggage greater than that authorized for the vehicle, according to the number of seat belts.
Transport of luggage on top of the vehicle (it is not authorized to place a roof rack in the vehicle).
Leave objects in sight in the vehicle.
Dirty the interior of the vehicle.
Driving the vehicle in a state of fatigue, illness or under the influence of alcohol, medication or drugs.
Reckless driving.
Driving contrary to traffic regulations.
Driving the rented vehicle by a person not authorized in the contract either as Lessee/s or additional driver/s.
Driving the vehicle outside the permitted territory, established in point 16 of these conditions.
Use of the vehicle after the end of the rental period.
Do not take a baby and/or child seat if you are traveling with children under 12 years of age or any person less than 135 centimeters tall.
SMOKING IS STRICTLY PROHIBITED INSIDE THE VEHICLE.
13. Traffic offences:
The Renter will be responsible for the immediate payments of the fines caused by any infraction of the law during the rental period. The Lessee must inform the Lessor of any fine imposed on the Vehicle or the driver during the rental period. The payment of fines is not included in any of the coverages that can be contracted. In the event that the authorities retain the Vehicle due to an act or omission by the Lessee, whatever the cause, the Lessee will be responsible and will indemnify the Lessor for all expenses and lost profits incurred for such reason.
14. Joint and several liability:
All Lessees and/or additional drivers will be jointly and severally liable for all the obligations assumed by the Lessee in the Contract and all the legislation applicable to it.
15. Fuel policy:
b) Full/Full: At Check-Out, the Lessor agrees to deliver the Vehicle's tank full, for his part, the Lessee will also undertake to return it full at Check-In. If the obligation to fill in the Landlord is not fulfilled, the Lessee may demand at the time of Check-Out that the Vehicle be delivered with a full tank, if he does not claim it at that moment it will be understood that he is satisfied. If, on the contrary, it were the Lessee who failed to comply at the Check-In, an expense will be charged for refueling management, the minimum amount being €100.
16. Territory allowed:
The Vehicle may only be driven in Spain. The Vehicle may not be shipped or transported by any means of transport, except with prior and reliable authorization in writing from the Lessor.
It is reported that some of our vehicles have geolocators and if it is detected that they have exceeded the permitted territory, it will be considered a breach of the Contract, and the Lessor may charge the Lessee with estimated damages of €950 plus €290 per tow truck and all possible damages and excess mileage, immediately rescinding this contract for breach of contract by the Lessee and taking the appropriate legal measures.
17. Mileage:
The mileage in all our rates would be unlimited, keeping the Lessor to charge a plus in exceptional cases.
18. Home service:
The home delivery service is only available within a radius of 50 kilometers from our facilities at C/Granada, 23 Rute (Córdoba) with a minimum amount of €20 for collection or delivery.
19. Payment:
All services will be paid in advance by credit, debit or cash card at our facilities. Payment for reservations via our website can only be made by credit card.
20. Currency:
The rates established by the Lessor are valued in Euros (€). Not accepting in any case the payment in cash of any currency other than the Euro.
21. Taxes:
All the prices detailed in the rates include the Value Added Tax (VAT) at 21%. The Lessor is exempt from paying any other fee or tax that any state, regional or local authority may establish during the course of this Agreement.
22. Jurisdictional submission and Applicable Law:
This contract is governed by all the Spanish Legislation that affects it. The Parties expressly submit to the Transport Arbitration Boards, Courts and Tribunals of the competent territory, for any incidents and issues arising from this contract, except those that deal with Consumer matters, which will be governed by the jurisdiction established in its own regulations.
23. Cancellation policy:
All cancellations must be made in writing to the following email address (yet to be specified). Not refunding any amount for reservation made, except for reasons of force majeure (natural catastrophe, wars, attacks, death or serious illness of the Lessee, their parents, siblings or children) reliably accredited at the addresses indicated above.
24. Customer service and claims:
If you wish to make any suggestions about improving our services, we are at your disposal by email (email to be specified) and also all our facilities have official claim forms that will be kindly delivered to you when you request them from our employees.
25. Framework agreement:
These conditions have the character of a framework contract, being applicable to all rental contracts entered into by the same lessee with HP VEHICLE RENTAL.
26. Translation:
The Lessee has the right to receive a copy in Spanish of these general conditions and this will be stated in the versions of the same written in other languages, informing them in our facilities of which languages we have at that time. In case of discrepancies, the final version will be the one written in Spanish.
